 Your Statutory rights are not affected by any of the following Terms of Trade. Please Note that their are differences in terms between different suppliers - please read to the end of the page!! Terms of Delivery and Payment for GoKi products K-Play International is the exclusive UK Agent of Gollnest & Kiesel KG, Hauptstrasse 13-16, D-21514 Güster, Germany - hereafter referred to as GoKi. For all deliveries of products other than mishidesign, only the following terms of delivery and payment of GoKi are valid: Requested changes by the customer require written approval. GoKi reserves the right to vary both the technical details and the shape and colour of their products. Where given, weights, sizes, capacity performance and colours etc are for guidance only. Prices All prices are quoted net, ex warehouse and are subject to alteration without notice. With the publication of a new price list all previous price lists lose their validity. Packaging costs are included in the prices so far as no special packaging has been requested by the customer. Payment Payment in advance 4% discount Payment received within 10 days of date of invoice 2% discount Payment received within 30 days date of invoice net Credit Card Payment at anytime net Failure to pay within 30 days of date of invoice, entitles GoKi to charge a penalty interest of 10% per annum beginning from the due payment date. Foreign payments must arrive free of any charges. Customer credit is wholly at GoKi's discretion. Discount A discount of 3% is offered on orders over £1000 net. Delivery Charges: On net order value under £200 there is a £7.00 freight charge On net order value above £200 delivery is free of charge Goods will be packaged as is customary in the trade. Any article out of stock will be cancelled and should be re-ordered with your next order. Industrial action, fire, war, natural catastrophes, hijacking, acts of God and other unusual uncontrollable events, relieves GoKi from the sales contract and duty to fulfill it, for the duration of those events. Any claims for damages, due to negligence on the part of GoKi, will be limited to the purchase price. Costs arising due to obstacles to delivery created by the customer, are the customers responsibility. Delivery always takes place at the buyer's risk and expense unless otherwise stated. This risk comes into force when the goods leave the hands of GoKi into those of the freight forwarder (post, rail, shipping agent, courier etc.). Guarantee Obvious defects to products must be notified within 8 days of delivery. Non obvious defects must be notified within 8 days of discovery but at the latest within 6 months of delivery. In the case of a justified claim within the time limits, GoKi will choose, either to deliver a replacement free of charge, or to correct the defects. An adequate period of time to carry out these measures must be allowed. Should the replacement or correction be similarly damaged, the customer is entitled to claim a reduction in price or to cancel the order. Further claims are not allowed unless willfull or gross negligence can be shown. Under no circumstances should goods be returned without prior written approval - goods returned without approval will be turned away! Ownership Goods delivered remain the property of GoKi until full payment of all outstanding debts is fulfilled, including those arising out of future transactions, has been received - even if payment on certain named goods takes place. Goods belonging to GoKi are only to be sold in normal business transactions if payment of the debt to GoKi is ensured through this resale and their title to these goods is forwarded to the buyer. At this point the debts to GoKi are due. The authorisation to resell can be revoked at any time. Goods still the property of GoKi are not to be mixed with other goods or to be worked on. NOTE: It is stressed that the retail trade is under an obligation to hand out the CE remarks loosely accompanying some of the goods to the consumer together with the goods!
